Organization Wishes to Change Texas Legal Limit

The National Academies of Sciences, Engineering and Medicine has recently released a report as to why Texas should change the legal limit from .08 to .05 BAC. The National Academies has spoken out about how states with a low BAC of .05 tend to have less fatalites involving DWI. The agency also hopes to impose other types of legislation which would enhance the penalties of selling alcohol to minors and to increase the tax of alcohol significantly. The new legislation is controversial at best. It’s always important to keep the safety of others in mind, but a lowered legal limit could lead to issues. Our managing attorney, Tyler Flood, gave a statement as to why changing the legal limit could be an issue. Attorney Flood states that “Going from 1.0 to .08 was a difference of about one drink. Going from .08 to .05 is probably going to the be the difference of about two drinks.” If the legislation passes, then Texans will have to watch their alcohol intake even more. A single drink has the potential of raising your BAC from 0 to .02 BAC. Meaning the new legal limit might just bring more DWI convictions for Texans. We’ll have to wait and see if the National Academies is successful. Hopefully, the legislation won’t pass so there isn’t any more DWI convictions than necessary.
