A lab technician associated with the Houston Forensic Science Center (HFSC) has admitted to mislabeling a DWI blood sample in 2013. The incident wasn’t reported to the court according to defense attorneys who would have used the information for their case. This isn’t the first time HFSC has been under the radar for improper procedures. The crime lab was already handling scrutiny from reports of a lab supervisor who repeatedly gave false testimony about her qualifications. These issues could force the District Attorney’s Office to reexamine DWI cases over the last ten years. Criminal defense attorney and partner at Tyler Flood & Associates, Inc., Tyler Flood, stated that “It’s shocking, but it keeps happening. It’s a continuation of a very disturbing pattern at the DA’s office of not disclosing very important information that defense attorneys need to know in order to defend their clients." The forensic mistake was found out by Precinct 4 Constable Mark Herman as he was conducting an independent audit following the destruction of thousands of pieces of evidence. The Precinct had their property room recently be the subject of scrutiny after a deputy disposed of evidence dating back to 2007 in which only two pieces of evidence could not be found.
